Standard Terms of Business  for Solo Fine Artist

1. Scope of Work:

   a. The artist, referred to as "Artist," agrees to provide original works of art in accordance with the client's requirements, referred to as "Client."

   b. The Client agrees to engage the Artist for the creation and delivery of artwork as per the agreed-upon terms.

2. Artwork Specifications:

   a. The Artist shall create artwork in their unique style, using the mediums agreed upon with the Client.

   b. The specifications of the artwork, such as size, materials, subject matter, and any specific requirements, shall be mutually agreed upon in writing.

3. Pricing and Payment:

   a. The pricing for artwork shall be agreed upon in advance between the Artist and the Client.

   b. A non-refundable deposit of 50% of the agreed price is required before the commencement of the artwork.

   c. The balance payment shall be due upon completion of the artwork, prior to delivery.

   d. Payments shall be made in the currency agreed upon, via cash, bank transfer, or any other mutually acceptable method.

4. Copyright and Ownership:

   a. The Artist retains the copyright and ownership of all artwork created, unless otherwise agreed upon in writing.

   b. The Client acknowledges that the artwork purchased is for personal use only and may not be reproduced, resold, or used for commercial purposes without the explicit permission of the Artist.

   c. The Artist reserves the right to use images of the artwork for promotional purposes, including but not limited to social media, website, and print media.

5. Delivery and Shipping:

   a. The Artist shall provide an estimated timeframe for the completion of the artwork, which may vary depending on the complexity and size of the project.

   b. The Artist shall package the artwork in a professional manner to ensure its safe delivery.

   c. Shipping costs and any applicable taxes or customs duties shall be the responsibility of the Client, unless otherwise agreed upon.

6. Cancellations and Refunds:

   a. In the event of cancellation by the Client, any deposit paid shall be forfeited by the Client.

   b. If the Artist is unable to complete the artwork due to unforeseen circumstances, the Client shall be entitled to a refund of any payments made.

7. Confidentiality:

   a. The Artist and the Client agree to maintain the confidentiality of any proprietary or sensitive information shared during the course of their engagement.

8. Dispute Resolution:

   a. Any disputes arising from this agreement shall be resolved amicably through negotiation and mediation.

   b. In the event that a resolution cannot be reached, the parties agree to submit to the jurisdiction of the courts in the Artist's locality.

9. Governing Law:   

   a. This agreement shall be governed by and construed in accordance with the laws of Scotland, regardless of its conflict of law principles.

10. Entire Agreement:

    a. This agreement constitutes the entire understanding between the Artist and the Client and supersedes any prior discussions or agreements, whether written or oral.

By engaging the services of the Artist, the Client acknowledges that they have read, understood, and agreed to these terms of business.
